Category 3

  • Australian workers make up at least 85% of the employer’s Australian workforce;
  • The Department of Home Affairs has approved at least one nomination for a Temporary Skill Shortage (482) or subclass 457 visa holder in the last 2 years;
  • The Department of Home Affairs has approved more than 97% of nomination applications in the last year;
  • The employer is not a sole trader or a partnership;
  • The employer has had an annual turnover of at least AUD$4M for the last 2 years;
  • The employer has been a standard business sponsor for at least 1 year;
  • The employer has complied with all sponsor obligations;
  • There are no adverse monitoring outcomes;
  • All Australian employees are paid in accordance with an enterprise agreement or internal salary table reflective of current market salary rates; and
  • The employer has written contracts of employment for all Temporary Skill Shortage (482) and/or subclass 457 visa holders that meets applicable National Employment Standards.

Become an accredited sponsor

Employers who intend to sponsor staff for subclass 482 or 494 visas might wish to consider applying for accredited sponsor status. An entity must meet certain eligibility requirements outlined by the Department of Home Affairs in order to obtain accredited sponsor status. In addition to the normal standard business sponsorship requirements, the sponsor must also meet the criteria for one of the 5 categories of accreditation status.
